Moving from a Single Tier SCIO to a Two Tier SCIO (or vice versa)

You can do this simply by making the necessary changes to your constitution, following the process within your current constitution and then notify OSCR of the change within 3 months. Please see the section on [First Steps](https://scvo.scot/support/changing-legal-structure) for a description the kinds of clauses that cover decision making by the members. 

You will need to send to OSCR: 

• the [Notification of Changes Made Form](https://www.oscr.org.uk/media/v0uiuwvx/notifications-of-changes-made-application-form.pdf) 

• a copy of the resolution of the SCIO’s members agreeing to the change. [OSCR have a resolution template for this](https://www.oscr.org.uk/media/xiunq1uq/2015-04-02-resolution-to-amend-the-constitution-of-a-scottish-charitable-incorporated-organisation-2.docx). 

• a copy of the updated constitution 

Please note: If you are making any other changes, you should check whether you need OSCR permission beforehand. Anything which might affect your charitable status such as changing your purposes, or the name of the SCIO, will need consent from OSCR before you can do it.
