Subsidy control is the legal framework that regulates how UK public authorities award subsidies to third parties, like voluntary organisations, to deliver policy objectives.
Under the regime, the first step for any public authority is to consider whether any “financial assistance” amounts to a subsidy. That involves considering whether the financial assistance meets the legal test set out in the 2022 Act.
Where the financial assistance does constitute a subsidy, the public authority must then consider how to award it lawfully, in line with the requirements of the 2022 Act.
