The implementation of important new measures in charity law is currently under way. One important change is that The Charities (Regulation and Administration) (Scotland) Act 2023 will extend the range of criteria that result in automatic disqualification. This could affect both your trustees and senior management.
Currently, individuals are automatically disqualified from being a charity trustee if they:
- have an unspent conviction for an offence involving dishonesty or an offence under the Charities and Trustee Investment (Scotland) Act 2005
- are an undischarged bankrupt or have a Protected Trust Deed
- have been removed under either Scottish or English Law or the courts from being a charity trustee
The new charity law measures will extend this criteria to include, for example, those convicted of terrorism, or who are on the sexual offenders register.
In addition, these criteria for disqualification, which have previously only applied to trustees, are being extended to include staff or volunteers who undertake a senior management function for a charity.

We will hear from both OSCR and charity and employment law experts from Morton Fraser MacRoberts on the possible repercussions of the key aspects of the changes, which are expected to be introduced in mid-2025.
